General
These Terms & Conditions (“Agreement”) apply to the goods and services provided by Munch Express. By purchasing our goods, placing an order, making a booking or using our services after these Terms & Conditions have been made available to you, you agree to be bound by these Terms & Conditions outlined herein and any further terms or agreements made between you and Munch Express.
Services
Munch Express provides mobile food and beverage services to workplaces, businesses, job sites and other locations.
Our services may include, but are generally not limited to:
Daily food van services;
Coffee van services;
Mobile food trailer services;
Catering for workplaces, functions and events;
School canteen services; and
The supply of food, beverages, snacks and related products.
The availability, location and timing of services and the range of products may vary from time to time, subject to any confirmed order or booking.
Individual Agreements
Orders, bookings, catering arrangements or other service agreements may further outline:
product prices and service fees;
dates and times;
service or delivery locations;
quantities and dietary requirements;
site access and service requirements;
inclusions and payment terms; and
any additional terms applicable to the particular order, booking or service, including cancellation conditions.
Any applicable terms will be provided before you place an order or confirm a booking.
Submitting a van request, catering enquiry or other service request does not guarantee acceptance or availability. Advance orders and bookings are subject to confirmation by Munch Express.
You are responsible for providing accurate and complete information when placing an order, making a booking or otherwise interacting with Munch Express.
Food and Service Requirements
You are responsible for notifying Munch Express of any allergies, intolerances or dietary requirements before purchasing food or placing an order. Munch Express will advise whether those requirements can be accommodated. You should not assume that a product is free from a particular allergen unless this has been expressly confirmed by Munch Express.
Nothing in these Terms & Conditions limits Munch Express’s obligations regarding food safety, allergen information or your rights under applicable law.
You are responsible for following any storage, handling, reheating and consumption instructions provided with the products.
Where you arrange for Munch Express to attend a workplace, job site or other location, you are responsible for obtaining any necessary site permission, providing safe and reasonable access and notifying Munch Express of relevant site requirements or restrictions.
Munch Express reserves the right to refuse or suspend a service where reasonably necessary for safety, inappropriate conduct, a material breach of these Terms & Conditions or failure to comply with reasonable safety instructions. Where practicable, we will notify you of the reason and provide a reasonable opportunity to resolve the issue.
Service details, including arrival times, locations, routes and product availability, may be changed where reasonably necessary. We will notify you as soon as reasonably practicable of any material change affecting a confirmed order or booking. If you do not accept that change, you may cancel the affected part and receive a refund for goods or services not supplied, without limiting your rights under applicable law.
Pricing & Payment
All applicable product prices, service fees and payment terms will be outlined before you place an order, confirm a booking or make a purchase.
Charges may include:
Food and beverage purchases;
Catering charges;
Agreed charges for special van or trailer bookings; and
Other charges disclosed and agreed for particular orders or services.
Any deposit requirements, payment deadlines or account arrangements will be specified in the relevant quotation, booking confirmation or other agreement.
Orders, bookings or payments may be processed through third-party ordering or payment platforms. Where this occurs, additional terms and conditions imposed by the relevant third-party provider may apply and will be made available before use.
Munch Express reserves the right to change its pricing, product range and service offerings from time to time. Changes will not affect the agreed price of a confirmed order or booking unless otherwise agreed with you.
Limitation of Liability
Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any liability that cannot lawfully be excluded or limited. The following provisions are subject to those rights and liabilities.
To the extent permitted by law, Munch Express disclaims all representations, warranties and conditions implied by law that may lawfully be excluded. This does not exclude any express promise made by Munch Express about its goods or services.
To the extent permitted by law, Munch Express is not liable for any indirect, incidental or consequential damages, including loss of business, revenue, opportunity or reputation arising from your purchase of our goods or use of our services, except to the extent caused by Munch Express’s negligence, breach of this Agreement or unlawful conduct.
Munch Express shall not be held liable for any failure or delay in fulfilling its obligations to the extent caused by circumstances beyond its reasonable control, including severe weather, transport disruption, site closures, government restrictions or other events outside our control. We will take reasonable steps to minimise the effects of any disruption and notify affected customers.
If Munch Express cannot fulfil a confirmed order or booking, you will be entitled to a refund for any goods or services not supplied, without limiting any other rights or remedies available under applicable law.
Munch Express is not responsible for the acts or omissions of independent third-party service providers engaged directly by you. This does not exclude our responsibility for goods or services supplied by Munch Express, including through our employees, agents or contractors.
Indemnification
To the extent permitted by law, you agree to indemnify and hold Munch Express harmless against reasonable losses and third-party claims to the extent caused by:
False or misleading information knowingly or negligently provided by you;
Your material breach of these Terms & Conditions or any applicable agreed order or booking terms;
Damage caused by your negligent or unlawful conduct; or
Your failure to comply with reasonable safety instructions or applicable site rules.
This indemnity does not apply to the extent that the loss or claim is caused or contributed to by Munch Express or its employees, agents or contractors. Munch Express must take reasonable steps to minimise any loss.
Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of New South Wales, Australia. The parties submit to the non-exclusive jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.
Changes to Terms
Munch Express reserves the right to modify these Terms & Conditions from time to time. Any changes will be effective upon publication on the website and will apply to new orders, bookings and purchases made after publication.
Changes will not retrospectively alter a confirmed order or booking. Any changes affecting an existing ongoing service arrangement must be made in accordance with that arrangement and applicable law.
